What debt collectors can and cannot say

Getting a call from a debt collector regarding an overdue bill can be an aggravating experience. More often than not, you are already aware of the debt and simply trying to find a way to pay it. The Fair Debt Collection Practices Act protects people all across Oklahoma and America from creditor harassment.

Every time a collector calls, they must identify themselves and let you know that anything you say will be used to collect the debt. They must also identify the original creditor. After that, they must let you know that you have the right to dispute the debt, and that you can demand verification of said debt. This must be done within 30 days. If no verification is provided, you may be able to consider the debt dropped.

What creditors cannot do is harass you in any way. They must call during reasonable hours, typically 8 a.m. to 9 p.m. your time. In addition, they cannot keep calling you if you have requested, in writing, them to stop. Be aware that doing so could lead to a lawsuit in order to settle the debt. Collectors may not call you at work, nor may they discuss the issue with anyone but you. Finally, debt collectors cannot threaten you with an arrest or a false claim to credit report agencies. They must remain professional at all times, never using offensive or abusive language.

Debt collectors must cease contact if you are represented by an attorney. If you are receiving calls from creditors, a lawyer may be able to help settle the issue.
